Electric scooters have become increasingly popular throughout Connecticut. With their increased use, however, comes an increased risk of accidents and serious injuries. Connecticut law establishes specific rules governing the operation of electric scooters.
Under Connecticut General Statutes § 14-286a, electric scooter operators generally have the same rights and duties as drivers of motor vehicles when operating on the traveled portion of a highway, subject to certain exceptions.
The law also requires scooter operators traveling slower than normal traffic to remain as close to the right side of the roadway as practicable and safe. Exceptions include passing another vehicle or scooter, making a left turn, avoiding hazards, and using designated bicycle or scooter facilities.
Connecticut law also requires scooter operators to keep at least one hand on the handlebars and prohibits operating while carrying an object that prevents the operator from using both hands.
Helmet requirements are particularly important. Connecticut requires anyone 17 years of age or younger operating an electric scooter on the traveled portion of a highway, at a skateboarding park, or in a park to wear properly fitted and fastened protective headgear that meets applicable safety standards.
Connecticut municipalities may also enact additional ordinances regulating electric scooters. As a result, the rules governing scooter operation can vary from one Connecticut municipality to another.
For purposes of a personal injury claim, determining whether a scooter operator, motor vehicle driver, municipality, property owner, or another party violated an applicable statute or ordinance can be an important part of establishing liability.
