On October 28, 2019 a Philadelphia State Court Jury awarded the sum of 33 million dollars to Tracy Reed-Brown in a claim against Rex Medical and Argon Medical Devices.
The claim stemmed from the malfunction of the Option Retrievable IVC Filter manufactured by Rex Medical and distributed by Argon Medical Devices.
This particular IVC filter perforated Ms. Reed-Brown's vena cavity. The vena cavity is a large vein that carries blood from the lower part of the body to the heart.
The verdict consisted of 3 million dollars of compensatory damages and 30 million dollars of punitive damages. Punitive damages are generally awarded when the Plaintiff proves intentional misconduct by the Defendant.
Presently, there are 790 pending lawsuits in Philadelphia State Court for the Mass Tort Program and there is an expectation that there is more to come down the pike.
